HRCSA filed a petition
under Article 184 (3) of the Constitution
A
petition has been moved in the Supreme Court of
Pakistan against the beneficiaries of the National
Reconciliation Ordinance (NRO) challenging the
eligibility of the beneficiaries. The Human Rights
Commission of South Asia, Friday filed a petition in
the SCP to arrest all the accused who were given
relief under NRO and also bring all absconders back
to the country through the Interpol. The petitioner
while making the federal government, federal
secretary Law and Justice, Secretary Election
Commission of Pakistan, all the provincial
government and former President General (Retd)
Pervez Musharraf as party, prayed to the court that
the former president promulgated NRO illegally which
benefited a number of accused of serious crimes.
HRCSA prayed that before the court to proceed
against General Musharraf under Article 6 of the
Constitution of Pakistan and therefore the petition
requested the court to order the government to take
action against the former president through High
Treason Act of 1973.
The
petitioner stated that after declaring NRO as null
and void, 8041 cases among which 7793 cases of
serious crimes by people belonged to Sindh were
being restored but hearing was not yet been started
on any single case since an end to the NRO by
November 28. HRCSA also challenged the eligibility
of members of the parliament in his petition and
added that members concealed many facts from the ECP
and got benefits under the infamous NRO. Human
Rights Commission south Asia added in his petition
that according to Article 63 of the Constitution of
Pakistan any convicted or absconder was disqualified
to be a member of the parliament. HRCSA therefore
requested the court to disqualify all members of the
parliament who were benefited under the NRO. All the
accused of murder, intent to murder and kidnapping,
including Muttahida Qaumi Movement (MQM) chief Altaf
Hussain, Dr. Imran Farooq, Saleem Shehzad, Kunwar
Khalid Younus, Dr. Safdar Baqri and others, who were
not granted bail by the courts, should be arrested
through Interpol and produced before the courts,
prayed the petition. The petition contended that
Article 63 of the Constitution (disqualification for
members of the parliament) as applicable to the
President as for the members of the parliament.
